Mr Michael Olsen, a Sales Executive at a Car Dealership, has been awarded £4,000 after a slip at work caused serious injury to his right shoulder and elbow.
On the day of his accident, Mr Olsen was walking through the main car showroom to his Manager’s office. On his route, Mr Olsen had to pass several show cars, one of which had a Point of Sales (POS) graphic stuck to the floor in front of the car to promote it.
Whilst walking over the POS graphic Mr Olsen slipped unexpectedly due to a defect in the POS graphic. His right foot slipped out from under him and he landed hard on his right shoulder and elbow.
Mr Olsen’s accident was noted down in the accident report book, but he did not seek medical attention until a few days later as he believed he was simply bruised.
Mr Olsen eventually underwent an x-ray of his right arm which revealed a hairline fracture of the right elbow.
Mr Olsen was signed off work and during this time was unable to perform everyday tasks, such as driving, and was unable to participate in his hobbies which included attending the gym and playing squash.
The insurer’s denied liability for Mr Olsen’s claim and disputed that the POS graphic had become unstuck or that it was in any way defective.
Court proceedings were therefore commenced on the basis that the POS graphic was in a defective condition and represented a slipping hazard.
The insurer’s continued to deny any liability throughout Court proceedings but matters were eventually settled in Mr Olsen’s favour without the need to proceed to a Trial.
Mr Olsen’s fall could have easily been avoided had the POS graphic been positioned somewhere more suitable or had not been defective. But thanks to the hard work and dedication of Robert Weeden, Assistant Solicitor at Express Solicitors, Mr Olsen received £4,000 in compensation for his claim.
