When you are involved in an accident, whether it’s a car incident or an injury at work often the first people you will deal with is insurers.
Insurance protects people and companies from having to pay out large amounts of money in the event of an accident.
When an incident occurs where the injured person was not at fault, insurance companies will usually offer a preliminary settlement sum outside of court.
Many people will accept this initial offer as it may seem high enough, and a quick conclusion avoids a large and drawn out court case, a thought that will put many people off instantly.
But in reality, the amount of money the injured person will actually be receiving will be significantly lower than they deserve. In fact, the Financial Services Authority (now the Financial Conduct Authority) state that those who turn down the insurer’s first offer and seek legal advice from an independent solicitor get an average of 2-3 times more money from their compensation claim.
The reason for this is that insurance companies reap financial benefits by under compensating people who have been injured, so they will offer a substantially lower payment as a way of profiting and ensuring that a case is dealt with quickly.
It is because of this that The Law Society has started a campaign entitled ‘Don’t Get Mugged By An Insurer’.
This new campaign encourages injured people to think twice before accepting their first compensation settlement they are offered.
The Law Society are becoming increasingly concerned about the issue of independence between an insurer and the person who is compensating the victim because there are no clear distinction between the two different services.
Independent solicitors working with this new campaign, such as those here at Express Solicitors, aren’t biased towards an insurance company, so they won’t be fighting to get their victim the lowest possible amount of compensation. Instead, they fight on behalf of their client to get them the highest financial award possible.
