Injured at work Council worker receives over 8,000% more compensation than the first offer

Client Stories

When Thomas P was originally encouraged to accept an £8,000 settlement by his original solicitor, he recognised that his health was worth so much more.

He made the right decision to switch to the team at Express Solicitors who helped him claim over £650,000 for an accident at work without going to court.

By listening to the client and taking him and his pain seriously, Richard Lowry and the team helped Thomas and his family through this terrible time with minimum complication and a significant payout.

Collapsing chair and Regional Pain Syndrome

Thomas P was working in his office when the accident happened at Manchester City Council in 2010, talking to a customer on the phone when his chair collapsed. As he fell backwards, he reached out with his right hand to try and stop himself, which badly damaged the nerves in his neck and shoulder. He woke up the following day in agony and felt paralysed, so went to hospital.

Despite original medical assessments downplaying the injury, Thomas suspected that this pain wasn’t normal:

“I had many tests and saw various consultants who maintained I sustained soft tissue damage but I knew my body – something wasn’t right. So I pushed for more tests and eventually I was seen by a nerve consultant. He said he’d seen this type of injury many times before and after nerve conduction tests he diagnosed regional pain syndrome, which is a condition characterised by chronic and debilitating pain.”

Fighting for fair and proportional compensation

After confirming the severity of his injury and the effects it will have on his life moving forward, Thomas wisely sought legal support. He originally contacted a personal injury lawyer in Manchester who advised him to settle for the employer’s original liability claim for £8,000.

However, this liability claim was only proportional for the original diagnosis of soft tissue damage. Not content with settling for less, Mr P considered whether his current solicitor was right for his case.

“Even when I showed him the nerve conduction tests he said I should settle, but I didn’t want to as I knew how much pain I was in and how bad my injuries were. Coincidentally, another partner in the firm was an expert in regional pain syndrome having suffered from it himself, so I changed solicitors.”

This proved to be a prudent move for Mr P, who reached out to Express Solicitors to review his case. Solicitor Richard Lowery and the team immediately took Thomas seriously, treated his injuries with the sensitivity and passion they deserved and sought to make the legal process as comfortable as possible for him. Thomas spoke in glowing terms about working with Richard and the team.

“My experience with Express Solicitors was brilliant. I thought I’d be just another number, but from the day Richard Lowery took over the case he was amazing, everything about him was professional and I couldn’t fault him.

“Richard had all the time in the world for me, he was prompt with replies and always had my interests at heart.”

Mr P made it clear to the team that he had been through a tremendous ordeal with his injuries and legal experience so going to court was the last thing he or his family wanted.

Richard took this concern seriously and focused on getting Thomas the best compensation package possible without asking him to set foot in a courtroom.

A landmark victory and huge payout for Thomas

A week before the claim was due to go to court, Richard and the team fought for a joint settlement meeting with Manchester City Council’s insurers to reach an agreement before advancing to litigation.

Here, Richard got the insurers to agree to £650,000 in compensation and avoided any courtroom drama. This represented not only a deserved financial payment for Thomas, but vindication that his injuries were as serious as he believed them to be from the start. A £650,000 compensation payment after the original settlement suggestion of £8,000 is a huge result for Thomas and his family. Thomas was extremely happy with how he was guided through the legal proceedings:

“I didn’t want to go to court – my family had been through enough and now, what I have achieved financially will ensure their future, even if I am never able to work again.

“If I ever needed anyone to represent me again it would be Richard and his team, who were professional and empathetic every step of the way.”
