£115,000 for injury at work victim after other firms turned him down
When David Sutcliffe was badly injured at work, leaving him with permanent injuries, many other firms rejected his case.
Almost resigned to his fate, David found our firm and made contact in a last ditch attempt to get legal help. Robin Patey and the Express Solicitors legal team saw a man with a legitimate claim and helped him recover £115,000 in damages to help set him up for his new life.
A broken handbrake leads to a broken shoulder
David was working as a recovery operator in Keighley when a handbrake failure on the vehicle he was recovering caused it to roll backwards and knock him off the back of his wagon.
He sustained severe injuries to his arm and shoulder, and was immediately rushed to A&E to be operated on.
The severity of his injuries meant that he could not work or perform basic household tasks for over sixteen weeks, during which time he could not drive and was in a great deal of pain.
A question of liability and a case to intimidating for others
David saw that his situation was deeply unfair. Because of factors outside of his control, he was unable to work and had sustained life altering injuries. Despite this, his case proved a bit too hot to handle for other firms,
“I approached two law firms, one of them a highly respected personal injury lawyers. Both of them said I didn’t have a case so I just left it.”
The sticking point for a case like this was proving liability for the accident. As the failed handbrake was in a vehicle being recovered and not that of David’s employer, it wasn’t a simple case of proving blame for the accident lay with them. David was almost willing to accept his lot in the situation and move on when he had a lucky brush with us.
“Then a year after the accident, I came across Express Solicitors by complete fluke. An investigator for the firm had come into my brother-in-law’s workshop looking for someone else and my brother-in-law got his card.”
Helping David make the most out of his situation
The question about where liability lay remained a difficult situation but solicitor Robin Patey wasn’t going to let that stop David getting what he needed to adjust to his new life.
Eventually, at a joint settlement meeting between Robin and the Defendant’s representatives, liability was settled on a compromised basis, with David winning a very significant compensation payment of £115,000. This was certainly a far cry from his belief that he would receive nothing for his troubles.
David was relieved to have Robin and the team in his corner during such a difficult time: “Robin got the papers from the previous lawyers and said I had a good case. I was amazed and reassured by his confidence, particularly as the other two law firms had none. It was because of this that I decided anything I won would be a bonus, so I was delighted at receiving £115,000.
“Robin and all his colleagues at Express Solicitors were supportive, pleasant and helpful. No claim is going to be completely stress free but I can honestly say that the firm put me at ease and made me feel very confident because I knew it was in safe hands.”
Due to his injury, David had to leave the job he loved but is now employed in an office role by another recovery firm. He concludes: “Express Solicitors spotted I had a case where other law firms thought I had none. Robin fought it well and got me a great sum. I would highly recommend the firm to anybody who thinks they may have a case, it is always worth double checking!”
