After Express helped a nurse from Preston win her injury case against Flip Out, another Express client has won their trampoline park injury case, securing a five-figure settlement in compensation.
Natalee Smith was an employee at the Better Newquay Trampoline and Play Park in Cornwall and was on a training day when instructors encouraged workers to test out the equipment prior to opening.
But after jumping into the foam pit, Natalee heard a crack in her back and was in immediate pain.
She was rushed to the hospital where medics diagnosed her with a bulging back disc and nerve damage. She would end up spending the next six weeks bedridden.
However, after a year of physio and relying on a walking stick, she was informed by doctors that her symptoms would likely last for life.
She started legal action through Express Solicitors, with Adam Farrell, Partner in Employers’ Liability, looking after her and her case.
Bosses at the park denied any fault but were found to have been negligent.
A Judge ruled that despite adhering to industry standard safety advice at the time, the foam pit attraction was still not safe to use. Natalee was awarded a five-figure settlement for her injuries.
Adam added: “This case highlights the inherent dangers of trampoline parks. We fought for years to win this case and hopefully, now trampoline park providers will improve their standards to protect staff and customers.”
Natalee said: “This has been a living hell. I have been ridden with mum guilt as I have missed out on years of making memories with my children.
“I have been unable to do normal parent things like cuddle my children, run down the beach or play in the park.
“I have just about got used to the pain, but I am now living life like an old person in a young body, it’s just not fair.
“I am glad the judge found that pit to be dangerous it should be closed immediately. If it can happen to a staff member then it can happen to anyone.”
