Mother secures £3,000 compensation for injury caused by dangerous product from Amazon

Client stories

Victoria Laughlan, personal injury specialist from Express Solicitors helped Samaira Riaz, mother of four from Greater Manchester, secure over £3,000 compensation after suffering a serious injury to her finger.

The injury to her index finger on her left hand, happened as a result of a common practice most of us can relate to – wiping down the soap suds off her shelves in her bathroom following her family’s bath time.

Unwittingly, Mrs Riaz went about cleaning her bathroom which involved wiping her new metal corner shower shelves, recently installed following a completed bathroom renovation.

Armed with the shower head in her right hand, she proceeded to wipe off the soap residue with her left hand but as she pulled away, she felt immediate pain in her index finger and a sudden gush of blood. She sustained a deep laceration which lifted off a large layer of skin from the top to the bottom of her finger.

Initially looking to provide product safety feedback to Amazon following the injury sustained by the £25 metal corner shelves, the company lacked empathy and offered her only a replacement product or £20 goodwill voucher. She then sought compensation from no win no fee compensation specialists, Express Solicitors.

Painful and inconvenient injury to hand secures £3,000 compensation

Leading on this case, Victoria, adds:

“Mrs Riaz experienced a painful and inconvenient injury to her finger from a product that was defective. It caused great distress for the family as the injury could have been a lot worse or could have badly harmed one of her four children. By law any product or equipment you buy should be safe for you to use if you’re using it properly and in the manner in which it was intended for use. Manufacturers are responsible for your wellbeing and must make sure they are following the extensive safety advice when placing these products on the UK market. You don’t need to prove that the manufacturer was negligent to make a defective product claim.

“Mrs Riaz experienced a painful and inconvenient injury to her finger from a product that was defective. It caused great distress for the family as the injury could have been a lot worse or could have badly harmed one of her four children”

“In this case, Amazon was the importer and therefore we filed a defective product claim against the manufacturer. Based in China this did mean working around different time zones and languages but we were able to deliver a satisfactory outcome for the family in a relatively short time period.”

Left in excruciating pain from the injury sustained by the defective product

“Unable to carry out her daily task on her computer as a customer service advisor for an online fashion house, Mrs Riaz had to be signed off work for a number of weeks while her finger healed.”

Recalling the accident, Samira said: “I’ve never experienced pain like it! It was immediately painful and there was a lot of blood and a large flap of skin hanging off. I’m always one for getting small injuries and the occasional skin burn from constantly cooking for my family, but this was another level. It was excruciating and I’ve never bled so much.”

After treating her finger at home that evening and taking pain medication, the injury was still bleeding the following morning. Mrs Riaz then attended her local A&E department and was discharged after having had her finger glued and bandaged and told to rest for five days. Unfortunately, Mrs Riaz faced multiple trips back to the hospital and her GPs as the wound began to smell and became infected. Unable to carry out her daily task on her computer as a customer service advisor for an online fashion house, Mrs Riaz had to be signed off work for a number of weeks while her finger healed.

Considering compensation for ending up in this circumstance, unable to work and support her family with daily household tasks, she reached out to Amazon to report the incident before exploring the claim further with local Manchester based, Express Solicitors.

Amazon dismissed the initial contact for compensation

“I was so shocked as to Amazon’s reaction that it pushed me to seek further compensation for my family. What might sound like a superficial injury turned out to be really painful, distressing and inconvenient for my family as I wasn’t able to continue to support my family at home or continue with my usual work commitments.”

“Having to keep the wound dry and clean isn’t as easy as it sounds when you have a big family to care for. Everyday tasks such as cleaning, washing up, showering, and dressing required someone to support me and proved equally difficult in using a keyboard for my job on a daily basis. Luckily my employers were really supportive and understanding.”

“During my recuperate period, it was one of my kids that said I must see if I could get compensation as I’ve been severely hampered by the injury to my finger. It then got me thinking that the situation could have been a lot worse if my child had gone to clean the metal shelf. Still in shock and frustrated at the lack of empathy shown by Amazon I did some online research into no win no fee options and found Express Solicitor.

Solicitor’s support helped me through the claim process

“Still in shock and frustrated at the lack of empathy shown by Amazon I did some online research into no win no fee options and found Express Solicitor.”

“It was important to me that any options were based locally, so I approached Express Solicitors initially for advice. They immediately showed an interest and concern, and Victoria was simply brilliant in the way she handled my case. Double checking all the medical reports for accuracy and picking up small discrepancies, as well as keeping me informed at every stage and securing the positive outcome put my mind at ease. I just simply wanted someone to take responsibility and consider that this injury could have been a lot worse. I’m really very pleased with the outcome. It’s certainly helped me support my family more than the initial £20 I was offered by Amazon!”

Express Solicitors approached case with compassion and support

“We sought to get a level of compensation that Mrs Riaz felt matched the inconvenience it caused her and her family.”

Commenting on the liable case, Victoria Laughlan, adds: “With Amazon deflecting the blame to the manufacturer we were able to put forward a comprehensive case on the personal injury sustained by Mrs Riaz through no fault of her own.

“We sought to get a level of compensation that Mrs Riaz felt matched the inconvenience it caused her and her family. We’re delighted that Mrs Riaz is happy with the level of compensation secured and she can now treat her family on their upcoming birthdays.”

Express Solicitors secured compensation and support

Mrs Riaz concluded: “I’m extremely grateful for the support Express Solicitors provided and the medical assistance in making sure I don’t have long term pain and movement issues from the injury. I’ve been attending hospital appointments to help with the numbness and lack of movement and I’ve been told I need to work through the pain to stimulate the nerves. I sometimes get the odd days of severe pain but I’m very lucky that the injury has healed well.”
