Life before the accident 

At the time of the accident, Marcus lived at home with his parents. He was studying a vocational course at a local college, with aspirations to pursue a career after completing his studies. Marcus was also a passionate football fan and held a season ticket at his local club.

How the accident happened

On the day of the accident, Marcus was a back seat passenger in a friend’s vehicle when it left the road. Despite wearing a seatbelt, he sustained life-changing injuries. The severity of his injuries left Marcus ventilated for two months and in and out of consciousness. In total, he spent 10 months in the hospital.

The injuries sustained

Marcus was left with a severe traumatic brain injury, profoundly impacting his cognitive abilities. His speech, memory, sequencing and social awareness have all been affected, rendering him vulnerable to behavioural outbursts in public. Additionally, epilepsy developed as a result of his injury, now managed through medication. With limited understanding of his accident and lacking capacity to make decisions or manage finances, Marcus’s mother acted as his litigation friend, and a professional financial deputy was appointed.

The case

This arrangement enabled his parents to regain some semblance of normality and return to work.

Mediation

A joint settlement meeting between our team and the defendants failed mainly due to dispute over the level of care Marcus needed. Both parties then agreed to a formal mediation with the benefit of a mediator and a successful settlement was obtained.

Life after the accident

The settlement agreed between the parties was approved by the High Court.
