An Express Solicitors client has been awarded £200,000 in compensation, after a nasty fall from a ladder at work caused significant injury to his left leg.
On the day of his accident, 3rd August 2011, the client was working at a farm owned by his father-in-law. The client was instructed to remove ivy from a barn wall; he was provided with a ladder to carry out this task but was not provided with any assistance to ‘spot’ him as he carried out the work, which involved using a chisel and hammer to remove the ivy. Unfortunately the ladder slipped, causing the client to fall backwards.
The client sustained a pylon fracture to his left leg, which was treated with various bouts of reconstructive surgery; he subsequently underwent eight operations and continued to have significant ongoing difficulties.
The client instructed Express Solicitors to act on his behalf on 30th September 2014, by this time the three year limitation period to bring a personal injury claim had expired. Nevertheless, partner and head of the Employer’s Liability department at Express, Richard Lowery, decided to take on the case and without delay the claim was issued at court and a medical expert was instructed.
The defendant denied liability in respect of the accident, they averred that there was no employment relationship between the client and defendant, and alleged the client voluntarily undertook the task of removing the ivy.
After disclosing further evidence to the defendant, they made an offer of £75,000 in attempt to settle the case out of court, however at this stage we did not have the medical evidence required to be able to value the case and after consulting a barrister, the offer was considered to be unreasonable.
Shortly after we obtained the medical report, which detailed the extent of the client’s injuries the defendant increased the offer significantly and thanks to the hard work of Richard Lowery, the client was awarded £200,000 in compensation.
