£6000 for cyclist who hit a defective Grid.

Mr Wheeler was cycling down Manchester Road in Mosely as he was cycling he has ridden over a defective grid as a result of which he came off his bike over the handle bars landing heavily on the road, striking his head, shoulder, right elbow, right wrist, both knees, right ear, right cheek, left wrist and neck and was taken by ambulance to A&E.photo of defect 3

The case was particularly difficult as neither the Council or United Utilities would accept responsibility for the sunken grid cover and kept pointing the finger at each other.

Ultimately legal proceedings were commenced against both the Council and United Utilities.  The matter was listed for a trial on the 26th April 2016.

An offer was made of £3,000 which was considered to be too low and the Claimant rejected this offer.  6 days prior to the trial a further offer was received of £6,000 put forward as a joint offer between both the Council and United Utilities in the sum of £6,000 which the Claimant accepted in full and final settlement of his claim.
